LICENSE AND TERMS AND CONDITIONS OF USE

The site www.habitatutah.org is a website (the “Site”) owned by Habitat for Humanity of Summit and Wasatch Counties, Inc. (“we”, “our” or “us”).  “You” or “your” means an adult user of the Site for itself and you as parent or guardian for any minor whom you allow to access the Site, for whom you will be held strictly responsible.  Your use of the Site indicates that you are bound by these Terms and Conditions.  If you don’t agree with these Terms and Conditions, don’t use the Site.

We reserve the right to change these Terms and Conditions at any time. Your continued use of the Site after any change is made to these Terms and Conditions indicates your acceptance of that change. As described below, if you don’t want to be bound by any change to these Terms and Conditions, your sole remedy is to stop using the Site.

LIMITED LICENSE AND SITE ACCESS

Habitat for Humanity of Summit and Wasatch Counties grants you a limited license to access and make personal use of habitatutah.org on the terms and conditions provided herein. This license does not include:  (1) any downloading (other than page caching) or modification of the Site, or any portion of it, without the express written consent of Habitat for Humanity of Summit and Wasatch Counties, Inc.; (2) any resale or commercial use of www.habitatutah.org or its contents; (3) any derivative use of www.habitatutah.org or its contents; (4) any downloading or copying of account information for the benefit of any third party; or (5) any or any use of data mining, robots or similar data gathering and extraction tools.

Neither www.habitatutah.org, nor any portion of the Site, may be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any purpose (commercial or otherwise) without the express written consent of Habitat for Humanity of Summit and Wasatch Counties, Inc.  You may not frame or utilize framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout or form) of Habitat for Humanity of Summit and Wasatch Counties, Inc. or other third party appearing on the Site without the express written consent of Habitat for Humanity of Summit and Wasatch Counties, Inc.   Any unauthorized use terminates the permission or license granted by Habitat for Humanity of Summit and Wasatch Counties herein.

PROHIBITED USES OF THE SITE

You agree not to use the Site:

  1. for any unlawful purposes;
  2. to upload, email or otherwise transmit or communicate any material that is or promotes conduct that is obscene, offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, defamatory, libelous, vulgar or illegal, that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual, that “stalks”, harasses or advocates harassment of another person, or that is otherwise objectionable, in each case as determined by us in our discretion;
  3. to upload, email or otherwise transmit or communicate any material that provides instructional information about illegal activities (this may include, but is not limited to, information about making or buying illegal weapons or providing or creating computer viruses);
  4. to upload, email or otherwise transmit or communicate any material that infringes any copyright, trademark, patent or other intellectual property right or moral right of any person, including Habitat, or that constitutes an invasion of the privacy or publicity rights of another;
  5. to upload, email or otherwise transmit or communicate any material that you do not have a right to transmit or communicate or that promotes an illegal or unauthorized copy of another person’s copyrighted work (this may include, but is not limited to, providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files);
  6. to harm minors in any way (this may include, but is not limited to, uploading, posting, ordering for print, emailing or otherwise transmitting or communicating any content that violates child pornography laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in sexual conduct);
  7. to forge headers or otherwise manipulate identifiers in order to disguise the origin of any content posted to, or otherwise communicated or transmitted through the Site;
  8. to upload, email or otherwise transmit or communicate any material which is likely to cause harm to our or anyone else’s computer systems, including but not limited to that which contains any virus, code, worm, data or other files or programs designed to damage or allow unauthorized access to the Site that may cause any defect, error, malfunction or corruption to the Site;
  9. for any activity that involves the transmission of “junk mail”, “chain letters” or unsolicited mass mailing or “spamming”;

10.  to promote information that you know or believe to be false or misleading;

11.  for any commercial purpose;

12.  to impersonate any person or entity, including, but not limited to, any officer, employee or agent of Habitat, or falsely state or otherwise misrepresent your affiliation with a person or entity; or

13.  to provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the U.S. Government as a foreign terrorist organization pursuant to Section 219 of the Immigration and Nationality Act.

Even though all of the actions described above are strictly prohibited, it is possible that another user of or visitor to the Site may violate these policies and that you may become exposed to material of the type described above. You waive your right to any damages, whether from us or from any third party, arising from or related to such exposure.
You further agree that:

  1. You will not interfere with or disrupt, or attempt to interfere with or disrupt, the Site or any servers, networks or equipment connected to or employed in conjunction with the Site, or disobey any requirements, procedures, policies or regulations relating to this Site;
  2. You will not provide any information to us that is false or misleading, that attempts to hide your identity or that you do not have the right to disclose; and
  3. You will not use email from us to create “spam” emails.

All content included on www.habitatutah.org, such as text, graphics, logos, button icons, images, data compilations and software, is the property of Habitat for Humanity of Summit and Wasatch Counties, Inc. or third parties, and is or may be protected by U.S. and/or international copyright laws.  The compilation of all content on this site is the exclusive property of Habitat for Humanity of Summit and Wasatch Counties, Inc. and is protected by U.S. and international copyright laws.

“Habitat for Humanity” is a registered trademark of Habitat for Humanity International, Inc., a Georgia non-profit corporation (“HFHI”), and is used by Habitat for Humanity of Summit and Wasatch Counties, Inc. under license from HFHI.  All “Habitat for Humanity” graphics, logos, page headers, button icons, scripts and service names, are trademarks or trade dress of HFHI or Habitat for Humanity of Summit and Wasatch Counties, Inc.  Neither HFHI’s nor Habitat for Humanity of Summit and Wasatch Counties, Inc.’s trademarks or trade dress may be used in connection with any organization or service that is not HFHI or Habitat for Humanity of Summit and Wasatch Counties, Inc., in any manner that is likely to cause confusion in the market or in any manner that disparages or discredits either HFHI or Habitat for Humanity of Summit and Wasatch Counties, Inc.  All other trademarks not owned by HFHI or Habitat for Humanity of Summit and Wasatch Counties, Inc. that appear on the Site are the property of their respective owner(s), who may or may not be affiliated with, connected to or sponsored by HFHI or Habitat for Humanity of Summit and Wasatch Counties, Inc.

WEBSITE POLICIES; MODIFICATION AND SEVERABILITY

We reserve the right to make changes to the Site, our policies, our Privacy Statement and these Terms and Conditions at any time. Your continued use of the Site after any such change indicates your acceptance of that change.  If you don’t want to be bound by a change, discontinue use of the Site.

If any of these Terms and Conditions shall be deemed invalid, void or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

TERMINATION

Should you be in violation of these Terms and Conditions, we may revoke your license to use the Site and suspend your right of access to the Site.  In such a case, we will have no liability to you.
